The Family and Medical Leave Act (FMLA) stipulates that eligible employees are entitled to a maximum of 12 unpaid weeks off when they are unable to work due to serious illness, immediately following the birth (or adoption) of a child, or to care for an immediate family member with a serious health condition.
You are eligible for family medical leave according to the U.S. Department of Labor, if you meet these requirements:
• You are employed by a company of 50 or more people
• You have been employed for at least 12 months
• You have worked a minimum of 1,250 hours during those 12 months
• You are employed at a worksite where at least 50 employees are employed within 75 miles of the worksite
Eligible employees have legal rights that protect them from being denied family and medical leave, or subjected to retaliation for taking it. Some common workplace retaliation scenarios include being fired, salary reduction, discipline, demotion, etc.
